CAYAsail Giveaway – Official Terms & Conditions

1. Promoter

The promoter of this competition is C.A.Y.A. Group LTD, trading as CAYAsail (the “Promoter” or “CAYAsail”), a company incorporated in the Republic of Cyprus.
Registered office: 1, Yuri Gagarin Street, Ayia Napa, 5330, Cyprus (where required by law).

2. Mandatory Meta Disclaimer (Release & Acknowledgement)

This promotion is in no way sponsored, endorsed, administered by, or associated with Meta, Facebook, or Instagram.

By participating, entrants acknowledge that:

• They are providing information solely to CAYAsail and not to Meta

• Meta bears no responsibility or liability whatsoever in relation to this competition

3. Eligibility

3.1 The competition is open only to individuals who:

• Are 18 years of age or older at the time of entry

• Have a valid Instagram or Facebook account

• Are legally permitted to participate under applicable laws

3.2 Employees, directors, agents, contractors, affiliates of CAYAsail, and their immediate family members are excluded.

3.3 CAYAsail reserves the right to request proof of age, identity, and eligibility at any time.

4. Competition Period

4.1 The competition opens upon publication of the giveaway post.
4.2 The competition closes at 23:59 (CET) on 13 February.
4.3 Entries submitted after this time will be invalid.

5. Method of Entry (Meta-Compliant)

To enter, participants must complete all of the following during the Competition Period:

• Like the giveaway post

• Follow CAYAsail’s official Instagram or Facebook account

• Tag three (3) individuals in the comments section of the giveaway post

5.1 No sharing of the post on timelines, stories, or elsewhere is required or requested.
5.2 Participants must not tag individuals in photos in which they do not appear.
5.3 Tagging is permitted only in comments, in full compliance with Meta policies.
5.4 Limit: one (1) valid entry per user per post. Multiple comments or interactions do not increase chances of winning.
5.5 Automated, fraudulent, duplicate, or manipulated entries will be disqualified.

6. Prize Description

6.1 The prize consists of one (1) free cabin on a CAYAsail sailing holiday.
6.2 Catalogue value: €5,500.
6.3 Duration: one (1) week.
6.4 Default sailing period: mid-September, exact dates determined by CAYAsail.

6.5 The prize includes cabin accommodation only and excludes, without limitation:

• Flights

• Transfers

• Travel or medical insurance

• Meals (unless explicitly stated)

• Personal expenses

• Visas, port fees, taxes, or any other costs not expressly included

7. Alternative Dates & Surcharges

7.1 The winner may request an alternative sailing date, subject strictly to availability.
7.2 If the selected date falls within high season or premium periods, the winner agrees to pay any applicable surcharge, as determined solely by CAYAsail.
7.3 Availability, vessel assignment, routing, and scheduling remain entirely at the discretion of CAYAsail.

8. Winner Selection & Verification

8.1 One (1) potential winner will be randomly selected and qualified from each giveaway post using AppSorteos.
8.2 The final winner will be selected and confirmed by CAYAsail.
8.3 The winner will be announced on 14 February via CAYAsail’s official social media channels.
8.4 The winner must respond within 7 calendar days of notification.
8.5 Failure to respond, meet eligibility requirements, or accept these Terms & Conditions may result in forfeiture of the prize and selection of an alternate winner.

9. Non-Transferability & No Cash Alternative

9.1 The prize is personal, non-transferable, non-exchangeable, and non-refundable.
9.2 No cash alternative or substitution will be offered under any circumstances.

10. Marketing, Publicity & Content Rights

10.1 By entering the competition, participants grant CAYAsail a worldwide, perpetual, irrevocable, royalty-free license to use any content related to their participation, including but not limited to:

• Profile images

• Usernames

• Public posts

• Photos, videos, testimonials

10.2 The winner agrees to participate in reasonable marketing and promotional activities before, during, and after the sailing holiday, using reasonable means and for a reasonable duration, without additional compensation.

11. Health, Safety & Charter Compliance

11.1 Sailing and maritime activities involve inherent risks. Participation is entirely at the entrant’s own risk.
11.2 The winner confirms they are physically and mentally fit to participate.
11.3 The vessel’s skipper has absolute and final authority at all times regarding safety, navigation, routing, scheduling, and onboard conduct.
11.4 Failure to comply with skipper instructions may result in refusal of boarding or disembarkation without compensation.

12. Assumption of Risk

12.1 By accepting the prize, the winner expressly acknowledges and voluntarily assumes all inherent risks associated with sailing, including but not limited to:

• Weather changes

• Sea conditions and vessel movement

• Slips, falls, seasickness

• Mechanical or navigational risks

13. Medical Fitness & Disclosure

13.1 The winner confirms they are medically fit to participate in a sailing holiday.
13.2 Any medical condition, medication, or limitation that may affect safety must be disclosed prior to departure.
13.3 CAYAsail shall not be liable for incidents arising from undisclosed medical conditions.

14. Force Majeure & Operational Necessity

14.1 CAYAsail shall not be liable for any delay, modification, suspension, or cancellation of the prize sailing resulting from events beyond its reasonable control, including but not limited to:

• Adverse or unsafe weather conditions

• Sea state or navigational hazards

• Mechanical or technical issues

• Port, marina, or authority restrictions

• Acts of God, governmental actions, strikes, pandemics, or force majeure events

14.2 Sailing itineraries, routes, ports of call, departure points, and schedules are indicative only and may be altered at any time for safety or operational reasons.
14.3 No compensation, refund, or alternative prize shall be due in such circumstances.

15. Limitation of Liability

15.1 To the maximum extent permitted by law, CAYAsail shall not be liable for any loss, damage, injury, delay, or expense arising from:

• Participation in the competition

• Acceptance or use of the prize

• Weather conditions, force majeure, or operational decisions

• Acts or omissions of third parties

15.2 CAYAsail shall not be liable for any indirect or consequential losses, including but not limited to:

• Missed flights or connections

• Additional accommodation costs

• Loss of enjoyment

• Loss of income or opportunity

15.3 Nothing in these Terms limits liability where exclusion is prohibited by law.

16. Third-Party Services

CAYAsail accepts no liability for the acts, omissions, or defaults of third-party providers, including but not limited to marinas, ports, transport providers, suppliers, or other vessels.

17. Data Protection

17.1 Personal data will be processed in accordance with EU GDPR and applicable Cypriot law.
17.2 Data will be used solely for competition administration, winner verification, and agreed marketing purposes.

18. Governing Law & Jurisdiction

18.1 These Terms & Conditions are governed by the laws of the Republic of Cyprus.
18.2 Any disputes shall be subject to the exclusive jurisdiction of the courts of Cyprus.

19. Acceptance of Terms

Participation in this competition constitutes full and unconditional acceptance of these Terms & Conditions.
